Arthur Kemp 111.
Attorney 8. V. Hayden, counsel for J.
Arthur Kemp, former chief and property
clerk of the police department, under in-
dictment for embezzlement and larceny,
to-day filed with Justice Barnard a certificate
of Dr. Nevitt as to the physical condition
ol Kemp. Dr. Nevitt says he has had
Kemp under observation for ten weeks, and
the former clerk is suffering from a severe
form of neurasthenia. He is restless, the
physician Bays, and suffers from insomnia
and mental instability, having a depression
of the melancholy type. In addition, tho
patient, according to the physician's certi-
ficate, has catarrh of the stomach, and has
lost thirty-five or forty pounds in weight.
Dr. Nevitt concludes bis certificate with
tho statement that Kemp could not undergo
trial at this time without serious danger to
his life.
Relying on this certificate, Attorney Hay
den asked the Court to formally postpone
the trial until next fall. He informed Jus
tice Barnard that a professional engagement
calls him to England and passage has been
secured on the St. l’anl leaving New York
next Saturday. He could not possibly re
turn within three weeks, he stated.
Assistant United States Attorney Turner
opposed the postponement of the trial until
October, saying it is the desire of Mr. Baker
to dispose of the case before the summer
recess of the Court. He announced that the
government will have a physical examina
tion of Kemp made. He asked the Court to
set the case for the third week of June.
Justice Barnard declined to set a date for
tho trial, remarking that the matter might
stand over until the report of the physician
employed by the government had been re-
ceived.— Wathington Star of Tuesday.
