- Description
-
Frank Gieser, the Lawton man whose
arrest was chronicled in the Northerner
last week, for a brutal assault on his
father, pleaded guilty to a charge of assault
and battery before Justice Stanton
of Lawton, Wednesday. The 'squire
promptly imposed a sentence of $200 fine
or 365 days in jail, completely ignoring
the fact that the limit of a justice's jurisdiction
in criminal cases is $100 or 90
days. Gieser is now in jail, and will
probably remain there 90 days, when he
will doubtless be released by the sheriff.
Before the sentence was imposed, the
magistrate was advised by the prosecuting
attorney as to the extent of his jurisdiction,
but he evidently consulted the statue, which fixes
the extreme penalty as he imposed it –
but it takes a circuit judge to make it stick.
