Description
An interesting point was presented in the case of Thomas H. Smith, a colored man, indicted for embezzlement of a letter. It appears that the letter in question was left on the first-floor of a residence whereas the person to whom it was. addressed lived in the third flat. Attorney
for the accused insisted that his client had not embezzled the letter from the United States. The question hinges on whether the carrier's leaving the letter on the first floor for a person on the third
floor constitutes delivery. If it does, then the theft, it is contended, was from the person to whom the letter was addressed, and not from the United- States. The Court took until to-day to consider what instruction he will give on the point. Court will reassemble at 11 o'clock this morning.
